Introduction Time to Shine Collective (“we”, “us”, “our”) provides counselling and related services from Queensland, Australia via this Site and in-person/telehealth consultations. We respect your privacy and are committed to protecting your personal and health information. This Privacy Policy describes how we collect, use, disclose and store your personal information and health information, and your rights under the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

  1. What information we collect

  • Identity and contact information: name, email, phone number.

  • Sensitive health information: mental health history, therapy notes, diagnosis, treatment plans, risk assessments, medication and other clinical information necessary for counselling.

  • Service and appointment information: session dates/times, billing, referrals, consent records.

  • Website data: IP address, device/browser details, pages visited, form submissions, cookies and analytics data.

  • Payment information: when you pay for services (processed by third-party payment providers; we do not store full card details).

  1. How we collect information

  • Directly from you: when you complete intake forms, make bookings, email or speak with us, or use our services.

  • From third parties: referrers, other health professionals (with your consent), emergency contacts, or as required by law.

  • Automatically via the Site: cookies and analytics tools (see Section 9).

  1. Purpose of collection and use
    We collect and use information to:

  • Provide counselling, clinical assessment, treatment and follow-up care.

  • Communicate with you about appointments, invoices and service-related matters.

  • Manage client records, billing and payments.

  • Comply with legal and regulatory obligations.

  • Improve our services and the Site (analytics, troubleshooting, website administration).

  • Respond to complaints or legal requests.
     

  1. Legal basis and consent
    For health and other sensitive information we will generally obtain your express consent. By engaging our services you consent to the collection, use and disclosure of your information as described in this Policy, except where disclosure is required or authorised by law.

    We may disclose your information to:

  • Other health professionals with your consent or where it is necessary for your care.

  • Emergency services or authorities when there is a serious and imminent threat to your or others’ safety, or where mandatory reporting laws apply (e.g., risk of harm to a child).

  • Third-party service providers who support our services (e.g., telehealth platforms, practice management/booking systems, payment processors, IT hosts, analytics providers). We use reputable providers and contractually require them to protect your information.

  • Legal, regulatory or law enforcement bodies where required by law.
     

  1. Confidentiality and limits
    Counselling records are confidential. Limits to confidentiality include:

  • Risk of serious harm to you or others.

  • Suspected child abuse or vulnerable person abuse where reporting is required.

  • Court orders or legal requirements. If we must disclose information for safety or legal reasons, we will tell you where practicable.

  1. Storage, security and retention

  • We hold records in secure electronic systems and/or encrypted storage. Paper records are stored securely.

  • We implement reasonable administrative, technical and physical safeguards to protect information against loss, unauthorised access, disclosure or modification.

  • We retain records in accordance with professional guidelines and legal requirements. Clinical records are generally retained for at least the minimum period required by relevant professional bodies and Queensland law; then securely destroyed or anonymised.
     

  1. International transfers
    Some third-party service providers may store or process data outside Australia. Where this occurs we will take steps to ensure your information is protected in accordance with applicable privacy standards (contracts, security measures).

  2. Cookies and analytics
    Our Site uses cookies and analytics (e.g., Google Analytics) to improve functionality and monitor usage. You can manage cookies via your browser settings; disabling some cookies may affect Site functionality.

  3. Access and correction
    You may request access to or correction of your personal information and clinical records. To request access or correction, contact us (details below). We will respond within the timeframes required by the Privacy Act. In limited circumstances we may refuse access (e.g., where access would pose a serious threat to life or safety or where a legal exception applies); if so we will provide reasons.

  4. Complaints and disputes
    If you have a privacy concern or complaint, please contact us first so we can try to resolve it promptly (contact details below). If still dissatisfied, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) — www.oaic.gov.au.

  5. Changes to this Policy
    We may update this Policy from time to time. The “Last updated” date at the top indicates when it was last revised. Significant changes will be notified on the Site.
